DOC De Minimis Waiver Overview

The de minimis waiver aims to prevent immediate delays in critical projects. The Department is implementing a waiver for infrastructure project purchases, allowing up to 5% of the total project cost or a maximum of $1,000,000.00, whichever is lower, for product categories including iron, steel, manufactured products, and construction materials. Additionally, the Department is establishing a waiver for small grants, with a threshold of $250,000.00, exempting them from the Buy American domestic content procurement preference.

How will the DOC’s de minimis waiver impact BEAD grants?

  • The small grant threshold of the de minimis waiver will extend to subrecipients from recipients. This applies particularly to classes or categories of Other Network Equipment utilized in broadband network deployments that may not be domestically available.
  • The de minimis waiver can be utilized for construction materials such as optical fiber or fiber optic cable, as well as electronic manufactured products or types of enclosures
